The internship contract

The internship procedure requires the conclusion of an “internship contract” which, although it resembles as, is not a contract of employment and this last one cannot be, in any way, concealed as an internship one. The internship contract will include, among other regulations, the work carried out by the intern (the tasks assigned to him / her), its duration and the amount of indemnity granted to the intern and it will be recorded by the company in its own register, and when the authorities will complete an official territorial register of internship contracts, it will need to be recorded in this register as well.

The host company (the employer) must appoint a mentor, who has  to be an employee with at least one year of experience in interns coordinating, controlling and evaluating. This person can coordinate up to 3 interns at the same time. To the extent that the host organization (the employing company) runs internship programs with more than 12 interns simultaneously, it is required to nominate an internship programs coordinator who will be responsible for implementing the program, together with the mentors.

Depending on the number of employees, the company, as a host organization, can simultaneously conclude internship contracts for a number of interns which may not exceed 5% of the total number of employees. By way of exception, the host organization with a maximum of 20 employees can simultaneously conclude maximum two internship contracts.

If the amount resulting from applying the 5% mentioned above has two decimals, the number of internship programs that the host organization can carry out will be calculated by rounding to the larger integer, if the decimal is equal to or higher with 5.

The internship programs can be organized at any time during a calendar year, and the length of an internship program (the duration of intern activity) cannot exceed 720 hours over 6 consecutive months.

A single internship contract can be concluded between the company and the intern. The same intern will be able to do more internships at the same time within the host organization, but only if they are different internships and their cumulative duration cannot exceed six months.
